The essays in this volume commemorate the 70th anniversary of Jacques Maritain's Pour la Justice, in which the French Thomist and future drafter of the Universal Declaration of Human Rights grappled with the moral, political, and religious challenges facing Europe in the aftermath of World War II. During this time Maritain reflected on humanism, Christian philosophy, the relation between freedom, religion and politics, and increasingly, on education. Several scholars reflect on the historical impact of Maritain's own writings during World War (...) II, Vatican II, and the Spanish Civil war. In other sections, contemporary Thomists suggest ways a resurgent Thomism can engage with the pressing issues of our own day. Essays on Thomistic ethics address problems in bioethics, the philosophy of love, and the foundations of Natural Law, while others tackle perennial problems in metaphysics and epistemology, such as the problem of free will, subjectivity, and the role of creative intuition in aesthetics. Still other essays apply Maritain's work on education to current challenges facing religious universities today. We investigated people's ability to infer others’ mental states from their emotional reactions, manipulating whether agents wanted, expected, and caused an outcome. Participants recovered agents’ desires throughout. When the agent observed, but did not cause the outcome, participants’ ability to recover the agent's beliefs depended on the evidence they got. When the agent caused the event, participants’ judgments also depended on the probability of the action ; when actions were improbable given the mental states, people failed to recover the agent's (...) beliefs even when they saw her react to both the anticipated and actual outcomes. A Bayesian model captured human performance throughout, consistent with the proposal that people rationally integrate information about others’ actions and emotional reactions to infer their unobservable mental states. Case reports about patients undergoing Deep Brain Stimulation (DBS) for various motor and psychiatric disorders - including Parkinson’s Disease, Obsessive Compulsive Disorder, and Treatment Resistant Depression - have sparked a vast literature in neuroethics. Questions about whether and how DBS changes the self have been at the fore. The present chapter brings these neuroethical debates into conversation with recent research in moral psychology. We begin in Section 1 by reviewing the recent clinical literature on DBS. In Section 2, we consider (...) whether DBS poses a threat to personal identity. In Section 3 we argue for engagement with recent empirical work examining judgements of when identity changes. We conclude in Section 4 by highlighting a range of ethical issues raised by DBS, including various cross-cultural considerations. (shrink)

Commentary about the role of AI in bioethics for the 10th anniversary issue of AJOB: Empirical Bioethics.

In defending his interest-relative account of knowledge in Knowledge and Practical Interests (2005), Jason Stanley relies heavily on intuitions about several bank cases. We experimentally test the empirical claims that Stanley seems to make concerning our common-sense intuitions about these bank cases. Additionally, we test the empirical claims that Jonathan Schaffer seems to make in his critique of Stanley. We argue that our data impugn what both Stanley and Schaffer claim our intuitions about such cases are. To account for these (...) results, one must develop a better conception of the connection between a subject's interests and her body of knowledge than those offered by Stanley and Schaffer. An extensive body of research suggests that the distinction between doing and allowing plays a critical role in shaping moral appraisals. Here, we report evidence from a pair of experiments suggesting that the converse is also true: moral appraisals affect doing/allowing judgments. Specifically, morally bad behavior is more likely to be construed as actively ‘doing’ than as passively ‘allowing’. This finding adds to a growing list of folk concepts influenced by moral appraisal, including causation and intentional action. We therefore suggest (...) that the present finding favors the view that moral appraisal plays a pervasive role in shaping diverse cognitive representations across multiple domains. (shrink)

Kant’s discussion of radical evil and moral regeneration in Religion Within the Bounds of Reason Alone raises numerous moral and metaphysical problems.If the ground of one’s disposition does not lie in time, as Kant argues, how can it be reformed, as the moral law commands? If divine aid is necessary for thisimpossible reformation, how does this not destroy a person’s moral personality by bypassing her freedom? This paper argues that these problems can be resolved by showing how Kant can conceive (...) the moral law itself as kind of grace which, willed properly, makes moral regeneration possible without destroying the autonomy of the individual. According to the Thomistic tradition, the Principle of Totality (TPoT) articulates a secondary principle of natural law which guides the exercise of human ownership or dominium over creation. In its general signification, TPoT is a principle of distributive justice determining the right ordering of wholes to their parts. In the medical field it is traditionally understood as entailing an absolute prohibition of bodily mutilation as irrational and immoral, and an imperfect obligation to use the parts of one’s body for the (...) perfection of the bodily whole. TPoT is thus a key element of the system of principles within which an individual exercises her right to life: it helps specify the nature, scope and limits of those actions by which an agent permissibly acts in order to preserve her life. While the Thomistic tradition and the Catholic Church have drawn clear conclusions from the principle regarding, e.g., direct sterilization and non-therapeutic experimentation on human subjects, less attention has been given to the implications of TPoT for non-therapeutic procedures that may positively impact biological functioning or supra-biological goals–that is, for human “enhancement.” We will explore the degree to which TPoT non-univocally guides our use of both artifacts and bodies. We will argue that a careful analysis of these distinct kinds of totalities suggests that the application of TPoT to artifacts and bodies is strongly isomorphic, which is what tempts advocates of the Principle of Autonomy to invalidly infer the absolute dominium of the individual over her body. The inference is invalid because this isomorphism also includes a principle of intrinsic value whose function is to resist the instrumentalization of both artifacts and bodies in some contexts; we are not even related to artifacts as advocates of absolute autonomy believe we are, let alone to our bodies. Rather, the limits of human dominium are determined by the nature and finalities, inherent or acquired, of the objects in question, and it will be argued that articulating these limits raises important, understudied, and fascinating questions about the permissibility of various kinds of human enhancement. This essay articulates and defends Aristotle’s argument in Politics 7.4 that there is a rational limit to the size of the political community. Aristotle argues that size can negatively affect the ability of an organized being to attain its proper end. After examining the metaphysical grounds for this principle in both natural beings and artifacts, we defend Aristotle’s extension of the principle to the polis. He argues that the state is in the relevant sense an organism, one whose primary end (...) is to make good reasons available to individuals and promote them as choiceworthy. The size of a polis can affect its ability to perform this function, since growth promotes anonymity among citizens, which in turn frustrates the familiarity between citizens required for the exercise of distributive and restorative justice as well as political prudence. This paper suggests several ways in which Aristotle’s argument, if sound, is important for contemporary issues in moral psychology, Ralwsian political philosophy, and big data analytics. (shrink)

Immanuel Kant offers definitions of “sexual desire” and “sexual use” in the Metaphysics of Morals that occasion an inconsistency within his moral system, for they entail that sexual desire, as a natural inclination that is conditionally good, is also categorically objectifying, and thus per se immoral according to the second formulation of the Categorical Imperative. Following Alan Soble, various attempts to resolve the inconsistency are here criticized before more suitable, and suitably Kantian, definitions of these terms are offered. On the basis of an analogy between wit and temperance, Curzer holds that the witty person is good at detecting (and avoiding) hateful humor but is not necessarily an expert in judging the funniness of jokes. Curzer thus defends a moderate position in contemporary philosophy of humor—a Detraction Account of hateful humor—arguing that (...) the humorousness of a joke is an aggregate plea- sure resulting from several factors in addition to funniness. While sympathetic to Curzer’s overall approach to wit, this essay criticizes the Detraction Account as inconsistent with Aristotle’s text and implausible in its own right, and suggests a friendly amendment based on those criticisms. This essay examines a dialogue between Kierkegaard and the Aristotelian tradition on the topic of love and friendship. At stake in the dispute is whetherphilia or agape is the highest form of love and how we should understand the relation between the two loves. The essay contributes to the conversation by analyzing two kinds of deceptive love identified in Kierkegaard’s Works of Love, viewing each through the lens of a Shakespearian persona. Against the Aristotelian tradition, Kierkegaard defends the idiosyncratic view (...) that Hamlet’s Ophelia is a villain and King Lear’s Cordelia is happy. Central to Kierkegaard’s argument is the contention that agape requires an epistemic attitude of charitable presumption towards one’s neighbor despite the possibility of error, an attitude found in Cordelia but not in Ophelia. The essay contrasts this Thomistic attitude with its Cartesian counterpart as well as their consequences for moral and religious life. (shrink)

ABSTRACTThis essay brings Martha Nussbaum's politically liberal version of the Capabilities Approach to human development into critical dialogue with the Catholic Social Tradition. Like CST, Nussbaum's focus on embodiment, dependence and dignity entails a social use of property which privileges marginalized people, and both theories explain the underdevelopment of central human capabilities in social rather than exclusively material terms. Whereas CST is metaphysically and theologically ‘thick', however, CA is ‘thin’: its proponents positively eschew metaphysical commitments, believing a commitment to quasi-Rawlsian (...) ‘overlapping consensus' is more consistent with political liberalism. This creates two tensions between CA and CST. The first is that CST understands the internal virtues of essentially social practices to be inseparable from their concrete instantiation in actual communities, while CA sometimes describes these virtues as political entitlements which can be supported independently o... This paper explores some ways in which artificial intelligence (AI) could be used to improve human moral judgments in bioethics by avoiding some of the most common sources of error in moral judgment, including ignorance, confusion, and bias. It surveys three existing proposals for building human morality into AI: Top-down, bottom-up, and hybrid approaches. Then it proposes a multi-step, hybrid method, using the example of kidney allocations for transplants as a test case.
